Buying property in the Dominican Republic
Q. What is the Dominican's government attitude toward foreign investment?
A. The Dominican government officially welcomes international investors. A foreign investment law enacted in December 1995 allows unlimited foreign investment in nearly all sectors of the economy. Governments change over the years but it is safe to say that at the moment the Dominican Republic still continues to encourage foreign investment.
Q. How are real estate transactions governed in the Dominican Republic?
A. Real estate transactions are presently governed by the Land Registry Law of amendments. A new Land Registry Law was enacted in 2005. Since then a number of small amendments and enforcements to the system have made for a safer and indeed clearer way to purchase property with much less risk to the investor.
Q. Are there any restrictions against foreigners owning real estate in the Dominican Republic?
A. There are no restrictions on foreigners purchasing real property in the Dominican Republic. In early 1998, laws were established stating that the only requirement for ownership is that the Title Registry Offices keep a record, for statistical purposes, of all purchases made by foreigners.
Foreigners are allowed to purchase property in the Dominican Republic with the same rights and obligations as a Dominican citizen.
Q. Is it relatively simple to acquire property in the Dominican Republic?
A. Acquiring property in the Dominican Republic is a straightforward transaction. However, anybody purchasing property in the Dominican Republic would be urged to exercise as much caution as they would with any other large financial transaction.
The agent working with you throughout the process should be able to assist you every step of the way. If you don't feel comfortable with a specific agent then perhaps you should find another prior to the stage where you are actively looking at property. You do not need to use the lawyer recommended by the agent. Hiring your own lawyer is therefore something you may wish to consider in order to avoid any conflict of interest. It is not uncommon for agents to recommend lawyers that they know and trust. It is easy to do your own research to check if recommended lawyers are exactly who they say they are.
You are ultimately responsible for due diligence with your lawyer to ensure that all documentation ranging from title searches to surveys to furniture inventories (if applicable) has been properly verified and processed.
